Please note the following guidance received from Marathon LB 121 basis new Carb Regulations for next year. Our understanding is that unless otherwise advised they will pay the remediation fund from their side and bill back to customer.
We are awaiting statement for LB 77/78 and 84/86, but our understanding is same process will apply.

You are receiving this email as you have a vessel scheduled to visit TLO’s Berth 121 Terminal on or after January 1, 2025. The California Air Resource Board (CARB) At-Berth Regulation will be going into effect for tanker vessel and terminal operators in the Ports of Los Angeles and Long Beach on January 1, 2025.
Tesoro Logistics Operations LLC’s (“TLO”) Terminal plan addresses how Berth 121 will comply with the requirements for ocean-going vessels visiting each berth and is available for public viewing on the
CARB’s website. Shore power is available for use at Berth 121, but barge-based capture and control is not currently approved for use. Unless your vessel is capable of using shore power, to comply with the Regulation, TLO will submit a request to CARB for use of the Remediation Fund for the scheduled visit. If your vessel has an eligible basis to directly seek approval of the Remediation Fund for the visit, please let us know as soon as possible.
As discussed in the Terminal Plan, to meet CARB At-Berth Regulation requirements TLO plans to employ land-based shore power and barge-based capture and control. Until the barge-based capture technology is sufficiently developed and approved to operate, TLO or its customers will request use of the Remediation Fund to achieve compliance for visits by vessels that are not shore power capable.
